TERMS & CONDITIONS

Drive Clean GmbH – valid for bookings, services, and sales on or after August 25, 2026

1. Scope and Provider

These General Terms and Conditions apply to contracts between Drive Clean GmbH, Gurtenweg 3, 3052 Zollikofen (hereinafter «Drive Clean»), and its customers regarding vehicle cleaning, vehicle care, vehicle detailing, specialized cleaning services, mobile services, work on vehicle bodies and windows, and the sale of cleaning and care products.

Any deviating agreements are valid only if they have been expressly confirmed by Drive Clean. In the event of any conflicts, an individual written agreement takes precedence over these TERMS & CONDITIONS terms.

2. Conclusion of the Contract

A contract is concluded in particular through a confirmed online booking, a confirmation by telephone, email, or message, an on-site booking, or through the commencement of the agreed service. The presentation of services and prices on the website generally constitutes an invitation to book. The booking confirmation as well as any individually confirmed additions are binding.

The customer is responsible for providing complete and accurate information regarding the vehicle, the desired service, and the condition of the vehicle at the time of booking.

3. Scope of Services and Deliverables

The scope of services depends on the booked package, the booking confirmation, and any additional services. Processing times mentioned on the website or in the brochure are guidelines. Depending on the vehicle size, degree of soiling, material, paint condition, and required workload, the actual duration may vary. The agreed package price is generally not affected by this.

Drive Clean performs the work professionally and with due care. It is not always possible to restore the vehicle to brand-new condition. In particular, we cannot guarantee that deep-seated stains, permanently absorbed odors, discoloration, scratches, stone chips, paint defects, corrosion, traces of mold, or materials that are already damaged or aged can be completely removed or restored to their original condition.

Services that are not explicitly included in the booked package will only be provided by separate agreement.

4. Prices and additional effort

All prices are listed in Swiss francs (CHF). Unless otherwise indicated, they include any value-added tax required by law.

Packages are billed at a flat rate. In cases of exceptionally heavy soiling, excessive pet hair, biological contaminants, the need for additional disassembly, special vehicle sizes, or additional work not apparent at the time of booking, a reasonable surcharge may be required. Drive Clean will, whenever possible, inform the customer before beginning the additional work and obtain their consent. If a necessary additional service is refused, Drive Clean may limit the service to the originally booked scope or refuse to perform the work if a professional result cannot otherwise be achieved.

The prices confirmed at the time of booking apply. Price changes only affect future bookings.

5. Obligations of the Customers

Before returning the vehicle, personal belongings, valuables, and any loose items that are not needed must be removed from the vehicle. Particularly valuable or fragile items must not be left in the vehicle unless they have been expressly handed over to Drive Clean for safekeeping.

Before work begins, the customer must inform Drive Clean of any known prior damage, loose or retrofitted parts, sensitive special equipment, electrical or mechanical malfunctions, leaks, window tinting, repainting, and any other special circumstances that may be relevant to the work.

As far as necessary for the booked service, the vehicle key is to be handed over and access to the vehicle is to be ensured. The customer confirms that they are authorized to commission the service and hand over the vehicle.

6. Appointments, Delays, Rescheduling and Cancellation

Rescheduling or cancellation is free of charge up to three hours before the scheduled appointment.

In the event of a rescheduling or cancellation less than three hours before the appointment, or in the event of a no-show, 80 % of the booked amount will be charged. This applies because the reserved time slot generally cannot be used for other purposes on such short notice. If Drive Clean is able to fully fill the appointment slot with another client, or if the customer can demonstrate that the loss was significantly less, this will be taken into account appropriately.

In justified exceptional cases, Drive Clean may waive the fee in whole or in part as a gesture of goodwill. There is no entitlement to such a waiver.

In the event of a late arrival, the service may be shortened to ensure that subsequent appointments can be kept; the agreed price generally remains payable. If professional execution is not possible in the remaining time, a new appointment can be arranged. Walk-in customers without an appointment are accepted depending on capacity; there is no entitlement to immediate service.

7. Payment

Private customers generally pay in cash or by card upon vehicle handover after the service is completed. Online payments via the booking system are not currently offered.

For corporate clients, payment on account and a consolidated invoice can be offered by prior arrangement. Unless otherwise agreed, invoices are payable within 30 days of the invoice date without deduction.

Once the payment deadline has passed, the customer is considered to be in default without further notice. Drive Clean may charge late-payment interest at a rate of 5 % per year, as well as reasonable, actual collection and reminder fees.

8. Acceptance, complaints and rectification

The customer should inspect the vehicle upon return and report any recognizable defects as soon as possible. Hidden defects must be reported without undue delay after their discovery.

In the event of a valid complaint, Drive Clean will first be given the opportunity to rectify the issue within a reasonable period of time. Customers’ statutory rights remain reserved. Reporting the issue immediately facilitates the assessment and resolution of the problem, but is not a prerequisite for enforceable statutory claims.

9. Liability

Drive Clean is liable for damages caused by willful misconduct or gross negligence. Liability for slight negligence is excluded to the extent permitted by law. This exclusion does not apply to damages resulting in death, bodily injury, or harm to health, nor does it apply to the extent that mandatory law precludes it.

Drive Clean shall not be liable, through no fault of its own, for pre-existing damage, normal wear and tear, material fatigue, corrosion, defective repairs or paint jobs, loose or improperly installed parts, or hidden prior damage or defects that were not detectable during a routine visual inspection prior to the start of work.

Drive Clean is liable for personal belongings or valuables that have not been removed only if they were expressly accepted for safekeeping or if the damage was caused by intentional or grossly negligent conduct on the part of Drive Clean.

10. Special cleaning and ozone treatment

For special cleanings, the scope, price, and result depend on the type and extent of the contamination. Prior consultation or a vehicle assessment may be necessary.

If an ozone treatment is booked to reduce odors and the odor has not been sufficiently reduced after the first treatment, Drive Clean will, upon request, perform a second ozone treatment at no additional cost. This service commitment is not a guarantee of complete odor removal. The cause may require additional cleaning, disassembly, drying, or replacement work; such work is not automatically included in the free second ozone treatment.

11. Polish and ceramic coating

The condition and thickness of the existing paint limit the possibilities for polishing. Not every scratch or paint defect can be safely removed. Drive Clean determines, as part of a professional service, how intensively the paint can be polished without unduly compromising it.

The effectiveness and durability of a sealant depend, among other things, on the condition of the vehicle, the preparation, usage, weather conditions, vehicle washing, and subsequent maintenance. Information regarding the expected durability is based on empirical values and does not constitute a guarantee of unchanged performance throughout the entire stated period.

12. Body, paint and window work

Drive Clean can perform bodywork, paint, and glass repairs in-house or engage suitable partner companies. Drive Clean remains the customer’s primary point of contact, unless otherwise agreed.

Settlement through an insurance company requires confirmation of coverage and costs from that insurer. Drive Clean cannot guarantee that an insurance company will cover all costs. Unless there is a binding commitment to cover the costs, the client remains obligated to pay. A contribution toward the deductible, a voucher, or any other benefit is valid only if it has been expressly confirmed on a case-by-case basis and is legally and underwriting-wise permissible.

Mobile Service

Where the mobile service is offered and booked, the same published service rates generally apply; the minimum order value is CHF 230. The standard service radius is 20 km from the Westside Shopping Center in Bern. Other locations are available upon request.

Drive Clean provides water, electricity, and a catch mat, but may use existing water and electricity connections with the customer’s consent. A covered area is not required, but is preferred. The service must be able to be provided on a legally permissible, accessible, and sufficiently safe surface.

For interior cleaning, the vehicle key is required. Handing over the key can also be advisable for exterior-only work, particularly because of an existing alarm system. Major polishing work is not offered as a mobile service; minor polishing work or individual spots can be carried out by arrangement.

In the event of unsuitable weather, safety, or venue conditions, Drive Clean may reschedule the mobile appointment or decline to perform the service. Any avoidable travel expenses already incurred may be billed if the unsuitable conditions were not disclosed at the time of booking.

14. Sale of products

The statutory warranty regulations apply to cleaning and care products sold on-site. Instructions for use and safety must be observed. Liability for damage resulting from improper use is excluded to the extent permitted by law.

15. Data Privacy

Drive Clean processes personal data related to bookings, services, payments, and communications in accordance with the Privacy Policy published on driveclean.ch.

16. Force Majeure

If a service cannot be provided, or cannot be provided on time, due to events beyond Drive Clean’s reasonable control—in particular due to government orders, power or system outages, accidents, illness, extreme weather conditions, or similar events—an alternative date will be agreed upon. Further claims may be asserted only in accordance with mandatory law.

17. Changes to the TERMS & CONDITIONS

Drive Clean may amend these TERMS & CONDITIONS terms for future contracts. The version published or otherwise incorporated at the time the contract is concluded shall apply to any transaction. Material changes to existing contracts may be made only with the consent of the affected customer, unless there is a legal basis for such changes.

18. Governing Law and Jurisdiction

Swiss law applies. The courts with jurisdiction under Swiss law shall have jurisdiction over any disputes. Mandatory statutory venues, particularly for consumers, remain reserved.

19. Severability Clause

If any provision of this TERMS & CONDITIONS is invalid in whole or in part, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provision.
